After an Accident

In California You Must:

Stop and Identify Yourself

Stop and Identify Yourself Whether the accident involves a pedestrian, a moving car, a parked car or someone's property. If you drive away, you can be charged with "hit and run" even if the accident is not your fault. Show your driver's license and registration card to the other driver. If the accident involves a parked car and you are unable to to locate the owner, you must leave your information and an explanation of the accident on that car and file a report with the police or CHP either by telephone or in person.

Offer Reasonable Assistance To Injured Persons

If you are not trained in first aid, do not move someone who is badly hurt, unless they are in danger of being hurt worse or killed. Alert other motorists of the accident by using flares, hazard lights, and lifting the hood of the car.

Call Police or CHP

Call Police or CHP If the accident has resulted in a death or injury, an officer will respond to the scene and make a report. You may be injured and not realize it due to shock and the stress of the moment. If you feel any pain at all, you should tell the investigating officer that you are in pain and request a collision report. An ambulance is a good idea if you are too hurt to drive safely from the scene. If you reported no injuries at the scene, but later find yourself in pain, you may fill out an injury traffic report at the same Police Department or California Highway Patrol office who responded to the scene.

Gather Information at the Scene

Gather Information at the Scene Try and get as much correct and complete information about the driver and vehicle that caused the collision as you can. Draw a simple diagram of all the cars involved in the accident. Note any skid marks, crosswalks, stop signs, traffic lights, street lights, etc. If you have a camera with you, take photos of the scene. LOOK FOR WITNESSES-record their name, address, and phone number.

Do Not Discuss Fault Or Responsibility

State only facts. Comments to police, paramedics, other driver(s), or anyone else present may be used against you later.

Notify Your Insurance Company

Your agent will assist you with your claims and, if you are sued, will assign an attorney. If you are sued for more than your policy covers, contact Attorney Jeffrey S. Dawson.

Report The Accident To The DMV

Report the accident to the DMV within 10 days if (1) property damage to any car exceeds $500, and/or (2) injury or death has resulted.
